I wanna move back into the house

My business at the house went under. My wife began making the most money. I began only keeping the child and working PT. we were shopping for a house. We found one but got into and argument. she bought the house in october 2010 she moved in about nov-dec2010 we made up in mid 2011 about sept I tried to come into the home when I arrived another guy was there. I had no idea about the affair. WE were still having relations together. the police were called they banned me from the house (I have since found out this was illegal they couldn't do that) ....since then I found out the guy was married. I told his wife. anyway my wife now claims I beat her. and got a Ex parte TPO DEC 20th finally i went to court friday and it was decided to do mutual tpo's until feb 29th when temp-custody is decided. can I ask to move back into the house at that time
